By accessing or using DreamSeed (the "Service"), provided by FluxForge LLC ("we," "us"), you agree to these Terms. If you do not agree, do not use the Service. You must be at least 18 years old, or the age of majority where you live.
DreamSeed plays user-chosen audio cues around sleep onset and records optional dream reports, a technique based on published research. Results vary and are never guaranteed. Dream influence is gentle and probabilistic; many sessions will not produce a themed dream. We make no claim that the Service will improve creativity, sleep, health, or any other outcome for you specifically.
Paid plans may include a Bluetooth heart-rate band. Included hardware remains subject to its manufacturer's warranty; we are not the manufacturer. Gift kits and redemption codes are non-transferable once redeemed and have no cash value. Compatible third-party sensors are used at your own discretion; we don't warrant any specific device.
Referral credits are promotional, capped (currently five referrals per year), have no cash value, and may be modified or ended at any time. Abuse, self-referral, or fraudulent activity voids credits.
Annual plans bill in advance and renew unless cancelled before the renewal date. You may cancel anytime; access continues through the paid term. Refunds, where offered, are at our discretion and described at checkout.
You own your dream reports and themes. You grant us a limited license to store and process them solely to operate the Service for you. Aggregated, anonymized research use is opt-in only.
You acknowledge the Service intentionally interacts with your sleep and may briefly wake you. You assume responsibility for using it in a safe environment and for deciding whether it is appropriate for you.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
To the maximum extent permitted by law, FluxForge LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or sleep, arising from your use of the Service. Our total liability is limited to the amount you paid us in the twelve months before the claim.
You agree to indemnify and hold harmless FluxForge LLC from claims arising out of your misuse of the Service or violation of these Terms.
We may modify the Service or these Terms at any time, with material changes posted here. We may suspend or terminate access for violations.
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. Venue lies in the state or federal courts located in Texas.
